Housing Land Supply Orders

Housing Land Supply Orders

The Tasmanian Government is undertaking a range of actions to address housing supply issues in Hobart and around the State.  In March 2018 it convened a Housing Summit to identify medium and long-term solutions to address this challenge.

One of these measures included introducing the Housing Land Supply Act 2018 which commenced on 20 July 2018 and has effect for a period of 5 years.

The legislation provides a process or 'Housing Land Supply Order' to enable surplus Government land that meets strict eligibility and suitability criteria to be rezoned for residential development more quickly. This accelerates the supply of affordable housing. The Act also enables the Order to include planning controls that better meet requirements specific to the site and provide greater consideration of local circumstances.

The Minister for Planning must consult with prescribed 'interested persons' set out in the Act. The Minister must also consider any submissions before submitting a report and the proposed Housing Land Supply Order to Parliament for debate.

If the Order is approved by Parliament, then development applications can be lodged for the normal planning assessment to the relevant local council for subdivision and/or construction of houses. For larger sites more detailed master planning of the site, and further stakeholder consultation by the Department of Communities Tasmania may occur prior to the submission of development applications.
