Housing Land Supply Orders

The Tasmanian Government is undertaking a range of actions to address housing supply issues in Tasmania. In March 2018 it convened a Housing Summit to identify medium and long-term solutions to address this challenge. Further solutions are also being progressed in response to the recent recommendations of the Premier’s Economic and Social Recovery Advisory Council (PESRAC).

One of the medium-term measures from the 2018 Housing Summit included introducing the Housing Land Supply Act 2018 (HLS Act). The HLS Act provides a quicker robust process for rezoning eligible Government land for residential purposes. The Government is currently considering options for extending the effect of the HLS Act.

The HLS Act enables the Minister for Planning to make a 'Housing Land Supply Order' to rezone Government land that meets strict eligibility and suitability criteria. Land is then transferred to the Homes Tasmania to deliver housing developments under the Homes Tasmania Act 2022. This accelerates the supply of social and affordable housing. The HLS Act also enables the Housing Land Supply Order to include planning controls that optimise the use and development of a site for residential purposes.

Amendments were made to the HLS Act in November 2021 to broaden the eligibility criteria and improve the consultation and assessment processes.  A further amendment was made in September 2023 to extend the period for making Housing Land Supply Orders until the end of 2032.

The Minister must consult on a proposed Housing Land Supply Order in accordance with the requirements set out in the HLS Act. All new Orders are subject to a 28 day public consultation period. The Minister must consider any submissions before submitting a report and the proposed Housing Land Supply Order for scrutiny by both Houses of Parliament.

If not disallowed by Parliament, the proposed Order can be made by the Minister and the land rezoned. Development applications can then be lodged under the normal planning assessment process through the relevant local council for the subdivision of the land and construction of houses. For larger sites, more detailed master planning, and further stakeholder consultation by the Homes Tasmania, may occur prior to the submission of development applications.

The following Housing Land Supply Orders have been made under the Housing Land Supply Act 2018:

  • Housing Land Supply (Chigwell) Order 2022 - effective 21 December 2022

    Amended the Glenorchy Local Provisions Schedule by:
    • Rezoning part of the land at Allunga Road, Chigwell (FR 197749/1) to the General Residential Zone.
    • The Tasmanian Planning Scheme is in effect in the Glenorchy municipal area.
  • Housing Land Supply (Howrah) Order 2022 - effective 21 December 2022

    Amended the Clarence Local Provisions Schedule by:
    • Rezoning part of the land adjacent to 31 Merindah Street, Howrah (FR 62918/35 and FR 62918/36) to the General Residential Zone.
    • The Tasmanian Planning Scheme is in effect in the Clarence municipal area.
  • Housing Land Supply (Burnie) Order 2022 - effective 13 July 2022

    Amended the Burnie Local Provisions Schedule by:
    • Rezoning part of the land at 16-20 Mooreville Road, Park Grove (CT1465514/1 and PID 6187275) to the General Residential Zone.
    • The Tasmanian Planning Scheme is in effect in the Burnie municipal area.
    • The Order has not changed the zone for the part of the land that contains the former University Campus.
  • Housing Land Supply (Romaine) Order 2022 - effective 13 July 2022

    Amended the Burnie Local Provisions Schedule by:
    • Rezoning the land at Roslyn Avenue, Romaine (PID 7695853) to the General Residential Zone.
    • The Tasmanian Planning Scheme is in effect in the Burnie municipal area.
  • Housing Land Supply (Warrane) Order 2022 - effective 13 July 2022

    Amended the Clarence Local Provisions Schedule by:
    • Rezoning part of the land at 213 Cambridge Road, Warrane (CT28/840) to the General Residential Zone.
    • The Tasmanian Planning Scheme is in effect in the Clarence municipal area.
    • The Order has not changed the zone for the part of the land that contains the Warrane Primary School.
  • Housing Land Supply (Huntingfield) Order 2020 (PDF, 1.9 MB) – effective 18 March 2020

    Amended the Kingborough Interim Planning Scheme 2015 by:
    • rezoning land at 1287 Channel Highway, Huntingfield (CT 172715/1, CT 172716/1, CT 134371/1 and CT 131270/2) to the General Residential Zone, Inner Residential Zone, Local Business Zone and Open Space Zone; and
    • applying clauses 8.4, 8.5, 8.6, 9.4, 9.5 and 9.6 of the State Planning Provisions in a modified form through a Specific Area Plan.
  • Housing Land Supply (Newnham) Order 2019 (PDF, 116.0 KB) – effective 4 September 2019

    Amended the Launceston Interim Planning Scheme 2015 by:
    • rezoning the land at 49 George Town Road, Newnham (CT 173634/2) to the General Residential Zone; and
    • applying a modified minimum lot size to the land through a Specific Area Plan.

    This is currently reflected in the Tasmanian Planning Scheme which is in effect in the Launceston municipal area.

  • Housing Land Supply (Devonport) Order 2018 (PDF, 188.4 KB) – effective 10 July 2019

    Amended the Devonport Interim Planning Scheme 2013 by:
    • rezoning the land at 39A North Fenton Street, Devonport to the Inner Residential Zone; and
    • applying clause 9.0 of the State Planning Provisions in a modified form through a Specific Area Plan.
  • This is currently reflected in the Tasmanian Planning Scheme which is in effect in the Devonport municipal area.

    • rezoning part of the land situated at 62 Ashbourne Grove, West Moonah to the General Residential Zone; and
